The Tribunal de police is competent to judge offences for which the Public Prosecutor's Office intends to request a fine, a monetary penalty or a custodial sentence of up to 2 years.

Competences

The Tribunal de police is competent to judge offences for which the Public Prosecutor's Office intends to request a fine, a monetary penalty or a custodial sentence of up to 2 years.

It is also competent when an objection is lodged against a summary penalty order of the Public Prosecutor's Office or the Contraventions Service and these authorities decide to maintain their decision.

The majority of proceedings are tried by the Tribunal de police, e.g. in cases of violations of the road traffic act and the narcotics act, theft, simple assault, etc.

Organization

Being a first instance authority, the Tribunal de police sits in a formation of one judge.
